Section 1 — Introduction and Parties

1.1 About PRO+ Skin Academy

These Terms of Use (“Terms”) constitute a legally binding agreement between you and PRO+ Skin Academy (“PRO+ Skin Academy,” “School,” “we,” “us,” or “our”), a Maryland-approved trade school licensed by the Maryland Higher Education Commission (MHEC) and approved by the Maryland Board of Cosmetologists. Our principal place of business is 11350 McCormick Road EP3 #1001, Hunt Valley, Maryland 21031, phone 443.330.7456.

1.2 Scope of These Terms

These Terms govern all access to and use of the PRO+ Skin Academy website, inquiry forms, state-approved programs, continuing education courses, on demand courses, online community platform, job board, ecommerce shop, and all other services we provide (collectively, “Services”).

1.3 Acceptance

By visiting our website, submitting an inquiry, creating an account, enrolling in a program or course, or purchasing any product or service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not access or use our Services.

1.4 Additional Agreements

Certain Services are also governed by separate agreements, such as an Enrollment Agreement for program students or a Loan Agreement for participants in our tuition loan program. Those agreements apply in addition to these Terms. In the event of a conflict, the more specific agreement controls with respect to that particular Service.

Section 2 — Eligibility and User Definitions

2.1 General Website Eligibility

Our website and Services are intended for users located in the United States who are at least 18 years of age, or at least 17 years of age with verifiable parental or guardian consent where applicable. By using our Services, you represent that you meet these requirements.

2.2 Program Enrollment Eligibility

To enroll in the PRO+ Skin Academy Esthetic Program or Lash Technician Program, you must satisfy all of the following requirements:

1. Be at least 17 years of age;
2. Hold a valid high school diploma or its equivalent;
3. Provide a government-issued photo ID;
4. Be proficient in the English language; and
5. Complete the enrollment and application process, including submission of the required application and payment of the nonrefundable application fee.

2.3 Continuing Education Eligibility

To enroll in PRO+ Skin Academy continuing education (CE) courses and receive CE credits, you must hold a valid, active professional license issued by the Maryland Board of Cosmetology and be capable of carrying out the objectives of the course within your scope of practice.

Out of state licensed professionals are welcome to attend all courses. However, they are solely responsible for confirming that our courses satisfy the continuing education requirements of the state that issued their license. PRO+ Skin Academy is not responsible for reporting or transferring CE credits to any state other than Maryland. Out of state license holders should contact their state board for guidance on approved course requirements before registering.

2.4 Professional Product Eligibility

Certain products in our online shop are designated as professional products and are available for purchase by licensed professionals only. By purchasing a designated professional product, you represent and warrant that you hold a valid, active professional license authorizing the purchase and use of such products.

2.5 User Definitions

For purposes of these Terms, the following definitions apply:

1. “Student” means an individual currently enrolled in the PRO+ Skin Academy Esthetic Program or Lash Technician Program.
2. “Member” means a licensed professional enrolled in a PRO+ Skin Academy monthly membership.
3. “User” means any person who accesses or uses our website or Services, including prospective students, enrolled students, members, course attendees, job board users, and shop customers.

Section 3 — Inquiry Submission and Communications Consent

3.1 Inquiry Collection

When you submit an inquiry through our website, you provide us with personal information including your name, phone number, email address, and other information relevant to your interest in our programs or services. By submitting this information, you consent to our collection and use of it to contact you regarding your inquiry and to process your enrollment or registration.

3.2 SMS and Text Messaging Consent

By submitting any inquiry form on our website, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., updates, offers, and reminders) from PRO+ Skin Academy at the mobile number provided. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out, HELP for help. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

After opting out, you may receive one final confirmation message. To opt back in, reply START or contact us directly at info@proskinacademy.com. Opting out of text messages does not terminate your enrollment, membership, or any other agreement with PRO+ Skin Academy. You remain responsible for monitoring your email for important communications.

3.3 Email and Telephone Communications

By providing your email address and telephone number, you consent to receive emails and calls from PRO+ Skin Academy. You may opt out of marketing emails at any time by clicking the unsubscribe link included in any marketing email we send you. Opting out of marketing communications does not affect our ability to send you transactional or service-related communications necessary to fulfill your enrollment, membership, or purchase.

Section 4 — Programs and Enrollment

4.1 Application Fee

All program applicants must submit a completed application and pay a $150 application fee. The application fee is nonrefundable under all circumstances, including withdrawal of the application, denial of admission, or subsequent cancellation of enrollment.

4.2 Enrollment Agreement

Enrollment in a PRO+ Skin Academy program requires completion of a separate Enrollment Agreement, which governs the specific terms of your enrollment, including program schedule, attendance requirements, grading standards, financial obligations, and additional school policies. These Terms apply in addition to your Enrollment Agreement.

Section 5 — Tuition, Fees, and Payment

5.1 School-Managed Loan Program

A tuition loan program is available exclusively to students who have been accepted into a PRO+ Skin Academy program. All tuition payment plans are owned by PRO+ Skin Academy and serviced by TFC. Loans originated through this program are reported to the consumer credit bureaus. Your credit standing will be affected based on the timeliness and consistency of your loan payments. Positive payment history may improve your credit profile; missed or late payments may have a negative impact.

Full loan terms, interest rates, repayment schedules, and all conditions will be disclosed to you in writing during the loan application process and prior to your execution of any loan agreement. You are responsible for reviewing all loan documents carefully before signing. PRO+ Skin Academy does not provide legal or financial advice, and you are encouraged to consult an independent advisor if you have questions about your loan obligations.

5.2 Payment Authorization

By submitting payment for any product, program, course, or service, you represent that you are authorized to use the payment method provided and that the information you submit is accurate. You authorize PRO+ Skin Academy or its payment processors to charge the payment method on file for all amounts due.

5.3 Student Kits

Student kits included in program enrollment are distributed during the program and become the property of the student upon distribution. Student kits are nonrefundable and are not eligible for return or exchange under any circumstances.

Section 6 — Refund and Cancellation Policy

6.1 Application Fee

The $150 application fee is nonrefundable under all circumstances.

6.2 Student Kits

Student kits are nonrefundable. Once distributed, kits may not be returned or exchanged.

6.3 Program Tuition

Refund eligibility for program tuition is governed by Maryland state law, Maryland Higher Education Commission regulations, and the refund schedule set forth in your Enrollment Agreement. Please review your Enrollment Agreement carefully for the specific tuition refund schedule applicable to your program.

6.4 Downloadable Materials

Downloadable materials provided through the PRO+ Skin Academy website and member portal are offered at no charge and are not subject to any refund policy.

6.5 CE Course Fees: Live Virtual Classes

Fees paid for live virtual continuing education courses are nonrefundable and nontransferable under any circumstances. Registered attendees are responsible for saving their confirmation email, which contains the calendar invitation and the secure link to join the virtual class. PRO+ Skin Academy is not responsible for technical difficulties on the attendee’s end that prevent participation, including internet connectivity failures, device malfunctions, or platform incompatibility.

6.6 CE Course Fees: In-Person Classes

Fees paid for in-person continuing education courses are refundable if a written cancellation request is received at least 72 hours before the scheduled class date. No-shows and cancellations received fewer than 72 hours before the class date are not eligible for a refund. Per state regulations, attendees who are not present within 10 minutes of the scheduled class start time will be marked absent, will not be permitted to join the class, will not receive CE credits, and will not be eligible for a refund.

6.7 Cosmetic Microneedling Kits

The Cosmetic Microneedling kit distributed with the Cosmetic Microneedling course is refundable if a written cancellation request is received at least 72 hours before the scheduled class date. If an attendee does not attend the class, they are responsible for contacting PRO+ Skin Academy during normal business hours to arrange pickup of their kit. All CE kits are distributed in class and are not shipped separately.

6.8 Dermaplaning and Other CE Kits

Dermaplaning kits and all other CE kits are included in the course fee and are not sold separately. They do not qualify as independent kit purchases and are not subject to a separate refund or return policy.

6.9 On Demand Courses

All on demand asynchronous course purchases are nonrefundable. On demand courses are available in the member portal for 60 days from the date of purchase. Access expires at the end of the 60-day period regardless of whether the course has been completed.

6.10 Membership

Monthly membership fees are not refundable for any portion of a current billing cycle. To cancel your membership, you must provide a written 30-day cancellation notice to PRO+ Skin Academy. Cancellations take effect at the end of the billing cycle following the expiration of the notice period. You will retain access to membership benefits through the end of your final paid billing cycle.

6.11 Job Board Postings

Job board posting fees are nonrefundable once a posting is live on the board. Job postings remain active for 30 days from the date of publication and will not be extended or transferred.

6.12 Online Shop: Skincare Products

All skincare product purchases are final. Skincare products are not eligible for return or refund under any circumstances.

6.13 Online Shop: Damaged Products

If a product arrives damaged, you must contact us at cs@proskinacademy.com within 14 days of the date of purchase, providing photos or documentation of the damage. We will review your claim and, if approved, provide a replacement or refund at our sole discretion.

6.14 Online Shop: Clothing and Apparel

Clothing and apparel items may be returned or exchanged for a different size within 30 days of the date of purchase, provided the item is unworn, in original condition, and has its original tag attached. Items that have been worn, washed, or returned without original tags will not be accepted for return or exchange.

Section 7 — Continuing Education Courses

7.1 Course Approvals

Continuing education courses offered by PRO+ Skin Academy have been approved by the Maryland Board of Cosmetologists and the Maryland Department of Labor. CE credits earned through our approved courses are valid for licensed professionals in Maryland and expire upon license renewal.

7.2 Attendance Requirements for CE Credit

To receive CE credits, attendees must be present for the entire duration of the live course, whether virtual or in-person. Attendance is recorded at the beginning of each live class. Attendees who join a live virtual class or arrive at an in-person class more than 10 minutes after the scheduled start time will not be permitted to participate, will not receive CE credits, and will not be eligible for a refund. No exceptions will be made.

7.3 On Demand Course Completion

For on demand asynchronous courses, attendees must complete the course and achieve a final passing grade of 75% or higher to receive CE credits. On demand courses are available in the member portal for 60 days from the date of purchase.

7.4 Certificate of Completion

A Certificate of Completion will be emailed to qualifying live course attendees within 72 hours of course completion. For on demand asynchronous courses, a Certificate of Completion will be available in the user’s member portal within 24 hours of successful course completion. Attendees and members are responsible for retaining their Certificate of Completion for their records.

7.5 CE Credit Reporting for Maryland Licensees

PRO+ Skin Academy reports CE credits to the Maryland Board of Cosmetology for all Maryland-licensed beauty professionals who successfully complete our approved courses. Reporting may take up to 14 days from the course completion date. PRO+ Skin Academy is not responsible for delays in processing by the Maryland Board of Cosmetology.

7.6 Domestic Violence Training

Domestic Violence Training offered by PRO+ Skin Academy is not a continuing education course and does not qualify for CE credits. Domestic Violence Training does not expire and must be completed one time within the licensed professional’s career.

PRO+ Skin Academy does not report Domestic Violence Training completion to the Maryland Board of Cosmetology. Attendees who complete the Domestic Violence Training are personally responsible for submitting their Certificate of Completion directly to the Maryland Board of Cosmetology.

7.7 Out of State License Holders

Licensed professionals holding a license issued by a state other than Maryland are permitted to attend all PRO+ Skin Academy courses. However, they are solely responsible for verifying that our courses satisfy the CE requirements of their licensing state before registering. PRO+ Skin Academy is not responsible for reporting or transferring CE credits to states other than Maryland and makes no representation that credits earned through our courses will be accepted by other state licensing boards.

Section 8 — Membership

8.1 Eligibility

Monthly membership is available to licensed beauty professionals. By enrolling in a membership, you represent that you hold a valid, active professional license. PRO+ Skin Academy reserves the right to verify licensure status and to suspend or terminate membership if eligibility requirements are not met.

8.2 Membership Benefits

Membership provides access to the PRO+ Skin Academy online community platform, member-only resources, course discounts, and other benefits as described on our website at the time of enrollment. Membership benefits are subject to change. We will provide reasonable notice of material changes to benefits.

8.3 Recurring Billing

Membership fees are billed on a recurring monthly basis beginning on the date of enrollment or such other date as communicated to you. By enrolling in a membership, you authorize PRO+ Skin Academy to charge your payment method on file each billing cycle until your membership is cancelled in accordance with these Terms.

8.4 Cancellation

To cancel your membership, you must submit a written cancellation request to info@proskinacademy.com with at least 30 days of advance notice. Cancellations take effect at the end of the billing cycle following the expiration of the notice period. You will retain access to membership benefits through the end of your final paid billing cycle.

8.5 No Refunds

Membership fees are not refundable for any portion of a current billing cycle, regardless of whether you actively use your membership benefits during that cycle.

Section 9 — Online Community and User-Generated Content

9.1 Community Platform

PRO+ Skin Academy provides an online community platform with forums and discussion features available to members and students. Participation in the community is subject to these Terms and any additional community guidelines we publish. PRO+ Skin Academy reserves the right to update community guidelines at any time.

9.2 User-Generated Content

You may post, submit, or share content on the PRO+ Skin Academy community platform, including text, images, comments, and other materials (“User Content”). By submitting User Content, you represent that you own or have the right to share such content, and you grant PRO+ Skin Academy a nonexclusive, royalty free, worldwide, perpetual license to use, display, reproduce, distribute, and modify your User Content in connection with operating and promoting our Services.

9.3 Content Standards

You agree that your User Content will not:

1. Violate any applicable law or regulation;
2. Infringe the intellectual property or privacy rights of any third party;
3. Contain false, misleading, or defamatory statements;
4. Contain spam, unsolicited promotional content, or solicitation messages;
5. Harass, threaten, intimidate, or harm any individual; or
6. Contain inappropriate, offensive, or harmful material of any kind.

9.4 Content Moderation

PRO+ Skin Academy reserves the right, but not the obligation, to review, monitor, remove, or edit any User Content that violates these Terms or our community guidelines, and to suspend or terminate the account of any user who repeatedly violates these standards. We are not liable for any User Content posted by you or any other user.

9.5 No Compensation

You will not receive compensation for any User Content you submit to the PRO+ Skin Academy community platform.

Section 10 — Job Board

10.1 Availability

The PRO+ Skin Academy job board is available to the general public for viewing. Business owners and employers may pay to post job openings on the board.

10.2 Job Posting Terms

Job postings remain active for 30 days from the date of publication at a one-time posting fee that is nonrefundable once the posting is live. By submitting a job posting, the posting owner represents and warrants that the posting complies with all applicable state and federal employment laws, including laws governing equal opportunity employment and anti-discrimination requirements.

10.3 Prohibited Conduct

All solicitation and spam-like messages on or through the job board are strictly prohibited. PRO+ Skin Academy reserves the right to remove any posting that violates these Terms and to block any user or business that engages in prohibited conduct.

10.4 No Employment Guarantee

PRO+ Skin Academy does not guarantee employment to any student, member, or user as a result of the job board. Job postings are provided as a convenience only, and PRO+ Skin Academy does not endorse or verify the accuracy of any posting, the qualifications of any employer, or the completeness of any job description.

10.5 Employer Responsibility

Employers and business owners who post job listings are solely responsible for compliance with all applicable employment laws. PRO+ Skin Academy is not a party to any employment relationship between job posters and applicants and accepts no liability for the content or conduct of job postings or the hiring process.

Section 11 — Online Shop

11.1 Products and Sales Tax

The PRO+ Skin Academy online shop offers physical goods including skincare products, professional products, and clothing and apparel. All orders are subject to applicable Maryland sales tax, which will be calculated and displayed at checkout.

11.2 Shipping

A flat rate shipping fee of $9.00 applies to all orders. Estimated shipping times are provided for informational purposes only and are not guaranteed. PRO+ Skin Academy is not responsible for carrier delays, lost packages, or delivery issues that arise after an order has been tendered to the shipping carrier.

11.3 Professional Products

Certain products are designated as professional products and are available to licensed professionals only. By purchasing a designated professional product, you represent and warrant that you hold a valid, active professional license that authorizes you to purchase and use such products. PRO+ Skin Academy reserves the right to cancel orders for professional products if licensure cannot be verified.

11.4 Final Sale: Skincare Products

All skincare product purchases are final. Skincare products may not be returned or refunded under any circumstances.

11.5 Damaged Products

If a product arrives damaged, you must contact cs@proskinacademy.com within 14 days of the date of purchase and include photos or documentation of the damage. Approved claims will result in a replacement or refund at PRO+ Skin Academy’s sole discretion.

11.6 Clothing Returns and Exchanges

Clothing and apparel may be returned or exchanged for a different size within 30 days of the date of purchase, provided the item is unworn, in its original condition, and has its original tag attached. PRO+ Skin Academy does not accept returns or exchanges of worn, washed, or tag-removed items.

Section 12 — Intellectual Property

12.1 Ownership

All content published on the PRO+ Skin Academy website, including course materials, videos, live session recordings, images, text, graphics, logos, downloadable resources, software, and community platform features, is the exclusive property of PRO+ Skin Academy or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

12.2 Limited License

PRO+ Skin Academy grants you a limited, nonexclusive, nontransferable license to access and use our content for your personal, educational, and professional development purposes only. This license does not permit you to:

1. Copy, reproduce, distribute, or publicly display our content without our express written permission;
2. Sell, license, or commercially exploit any content;
3. Modify, reverse engineer, or create derivative works from our content; or
4. Remove or obscure any proprietary notices, labels, or watermarks.

12.3 Trademarks

The name PRO+ Skin Academy, our logo, the tagline “Connect. Inspire. Grow.,” and all other brand identifiers are trademarks of PRO+ Skin Academy. You may not use our trademarks or branding in any manner without our prior written consent.

12.4 DMCA Notice and Takedown

If you believe that your copyrighted work has been reproduced on our platform without authorization, please send a written notice to legal@proskinacademy.com, Attn: Legal Department, with the following information:

1. Identification of the copyrighted work claimed to be infringed;
2. Identification of the material claimed to be infringing and its location on our platform;
3. Your full contact information, including name, address, telephone, and email;
4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
5. A statement made under penalty of perjury that your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Section 13 — Privacy and Data Collection

13.1 Privacy Policy

Our collection, use, and sharing of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you acknowledge and consent to the practices described in our Privacy Policy.

13.2 Inquiry and Enrollment Data

When you submit an inquiry or complete an enrollment application, we collect your name, phone number, email address, and any other information you provide. We use this information to contact you, process your enrollment or registration, facilitate communications, and, subject to your consent, send you information about our programs and services.

13.3 United States Only

Our Services are intended exclusively for users located in the United States. We do not knowingly collect data from persons located outside the United States. If you access our Services from outside the United States, you do so at your own risk and are responsible for compliance with all applicable local laws.

13.4 Minors Under 13

Our Services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at legal@proskinacademy.com so that we may delete the information promptly.

13.5 California Privacy Rights

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion of your personal information, and the right to opt out of the sale of your personal information. To exercise your rights, please contact us at legal@proskinacademy.com.

Section 14 — Disclaimers and Limitation of Liability

14.1 Services Provided As Is

PRO+ Skin Academy provides its Services on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness of our Services, course content, or materials for any particular purpose.

14.2 No Guarantee of Licensure or Employment

Completion of a PRO+ Skin Academy program does not guarantee licensure by the Maryland Board of Cosmetology or any other licensing authority, nor does it guarantee employment in any field. Licensure is subject to applicable state law and individual eligibility requirements.

14.3 No Guarantee of CE Credit in Other States

PRO+ Skin Academy makes no representation that CE credits earned through our courses will satisfy continuing education requirements in states other than Maryland. Out of state license holders are solely responsible for verifying CE approval with their licensing state before enrolling in any course.

14.4 Credit Reporting Disclosure

Loans originated through the PRO+ Skin Academy tuition loan program are reported to consumer credit bureaus. Your credit standing may be positively or negatively affected based on your payment history. PRO+ Skin Academy is not responsible for errors in credit reporting by third-party bureaus or lenders.

14.5 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRO+ SKIN ACADEMY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF OUR SERVICES EXCEED THE TOTAL AMOUNT YOU PAID TO PRO+ SKIN ACADEMY IN THE 12 MONTHS PRECEDING THE CLAIM.

14.6 Technical Issues

PRO+ Skin Academy is not responsible for technical issues on your end that prevent access to live virtual courses or digital content, including internet connectivity failures, device malfunctions, software incompatibility, or browser limitations.

Section 15 — Indemnification

You agree to indemnify, defend, and hold harmless PRO+ Skin Academy and its directors, officers, employees, instructors, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

1. Your access to or use of our Services;
2. Your violation of these Terms or any applicable law or regulation;
3. Any User Content you submit to our platform;
4. Your infringement of any third-party intellectual property or other rights; or
5. Any misrepresentation you make in connection with your use of our Services.

Section 16 — Dispute Resolution

16.1 Informal Resolution

Before filing any legal claim against PRO+ Skin Academy, you agree to contact us at legal@proskinacademy.com to describe the nature of your dispute and attempt to resolve it informally. We will make good faith efforts to resolve the matter within 30 days of receiving your written notice.

16.2 Governing Law

These Terms and any dispute arising from your use of our Services are governed by the laws of the State of Maryland, without regard to any conflict of law principles.

16.3 Jurisdiction and Venue

Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Maryland. You consent to the personal jurisdiction of such courts and waive any objection to venue in those courts.

16.4 Class Action Waiver

YOU AND PRO+ SKIN ACADEMY EACH AGREE THAT ANY DISPUTE SHALL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU EXPRESSLY WAIVE YOUR RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE OR COLLECTIVE ACTION AGAINST PRO+ SKIN ACADEMY.

16.5 Limitation on Time to File Claims

Any claim arising from your use of our Services must be filed within one year of the date on which the claim arose, regardless of any contrary statute of limitations. Claims not filed within this period are permanently waived.

Section 17 — Grievance and Complaint Process

17.1 Internal Grievance Process

PRO+ Skin Academy is committed to addressing student and professional concerns promptly and fairly. To submit a formal complaint, contact us in writing at info@proskinacademy.com with all of the following information:

1. Your full name and contact information;
2. A clear and detailed description of your concern; and
3. A summary of any prior attempts to resolve the matter with PRO+ Skin Academy administrative staff.

17.2 Maryland Higher Education Commission Appeal

If a student enrolled in a state-approved program is not satisfied with the resolution reached through our internal grievance process, the student has the right to appeal in writing regarding alleged violations of Maryland regulations to:

18.1 Changes to These Terms

PRO+ Skin Academy reserves the right to modify these Terms at any time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you by email or through a notice on our website. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms.

18.2 Changes to Services

PRO+ Skin Academy reserves the right to modify, suspend, or discontinue any part of our Services at any time, with or without advance notice. We will not be liable to you for any such modification, suspension, or discontinuation.

Section 19 — Account Suspension and Termination

19.1 Our Rights

PRO+ Skin Academy reserves the right to suspend or terminate your account or access to our Services at any time and without advance notice if you violate these Terms, engage in fraudulent or harmful conduct, misrepresent your eligibility, or if required by applicable law.

19.2 Your Rights

You may discontinue use of our Services or cancel your membership at any time. Termination of your account or access does not relieve you of any payment obligations incurred prior to termination, including tuition, loan payments, membership fees, or outstanding fees. Licensed professionals are responsible for downloading all Certificates of Completion from their member portal prior to account termination or membership cancellation. PRO+ Skin Academy is not responsible for providing access to certificates after an account has been closed or a membership has ended.

19.3 Survival

The following sections will survive any termination or expiration of these Terms: Section 12 (Intellectual Property), Section 14 (Disclaimers and Limitation of Liability), Section 15 (Indemnification), Section 16 (Dispute Resolution), and any other provisions that by their nature are intended to survive termination.

Section 20 — General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable Enrollment Agreement or Loan Agreement, constitute the entire agreement between you and PRO+ Skin Academy regarding your use of our Services and supersede all prior discussions and agreements on the same subject.

20.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20.3 No Waiver

PRO+ Skin Academy’s failure to enforce any right or provision of these Terms at any time will not be construed as a waiver of those rights.

20.4 Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. PRO+ Skin Academy may assign these Terms without restriction in connection with a merger, acquisition, or sale of all or substantially all of our assets.

20.5 Force Majeure

PRO+ Skin Academy is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, government actions, public health emergencies, power failures, or technology failures outside our control.
